Brand New 2551Q Form (Quarterly Percentage Tax) with 8% Opt In

On April 25, on the deadline of filing the Quarterly Percentage Tax Form, the BIR released RMC 26-2018 which has the new 2551Q form and the submission procedures for manual, eBIRForms, and eFPS.

The new 2551Q Form now has a field where you can indicate whether you’re opting for the 8% Flat Income Tax Rate. Also, SPOILER ALERT: 2551Q is not yet updated on eBIRForms and eFPS.

So for the procrastinators who put off their tax filing until the very last day of the deadline, congratulations!  😉

For the rest of us, it’s unlikely that the BIR will penalize us for not using the new 2551Q form when we submitted given the timing when they released this RMC. Moving forward, though, we have to make sure we’re filing this new one. The next deadline is on July 2018.

While we’re on the topic, if you missed filing your 2551Q, then you may no longer be eligible for the 8% Flat Income Tax Rate anymore. Basing on RR 08-2018, you had to make sure you filed your 2551Q on time. You can read more about our breakdown of that RR and how to opt in to 8% by visiting this article.

Having said that, there is a glimmer of hope. We noticed that the RDO’s are implementing things differently. If so, perhaps your RDO doesn’t see missing your 2551Q filing as a reason for ineligibility. To be sure, it would be best to call your RDO.

    1. According to the BIR RDOs, yes no need. HOWEVER, please do check with your RDO to be sure. We’re hearing reports that some RDO’s seem to be implementing things differently. It’s confusing, I understand – but it is what it is (and with your support and patronage, something we can fix!) 😀

  1. We are non vat homeowners association and previously using 2551M and 1702RT. Do we need to comply on the quarterly payment or just the yearly payment? What forms do we need to use under the train law. Thank you so much for your help.

    1. You have to comply with the quarterly payments. 🙂 You can read our other articles here about TRAIN to understand what else would impact you. Do note that most of these articles are aimed towards self-employed individuals so they might not be applicable in your case.

    2. Hi I am an insurance agent. I first filed my 2551Q last quarter of Dec 2020. My first 2551Q filed via BIR app was done last April 20., then got an acknowledgent email as well. But upon checking in the system,whenever I want to view it, the blanks showing ‘undefinned’ ( coz I want to check it before I file for thie Q2 of 2021).What does it mean?
      Moving forward, Is my gross sales is the amount I need to encode in page 2, under PT010 with 1% ,am I right?Because there are 2 PT010 in the alphanumeric section, the 3% and the 1% (just want to make sure)?!because I read about the CREATE LAW.
      Kindly assist with my queries.

    1. If you opted in to 8%, then there should be no need. However, the RDO’s may be implementing this differently so best for you to check with your RDO and ask. Thru Taxumo you can file 2551Q’s even if you’re on 8% — they’ll be zero tax forms.

My sister from the province owns an apartment and registered as non vat tax payer in NCR (TIN 000) and she’s paying the 3% percentage tax. however, she started a rice trading business located in the province where she resides – other RDO (TIN 001), is rice trading subject to the 3% percentage tax? Can the returns (2551Q and 1701Q) be filed separately (different nature of businesses & RDO) OR the returns should be consolidated in the 1st RDO? Please advise. Thanks.

  6. Hi! It said that if one opted to 8% income tax, he/she will no longer need to file/pay percentage tax. What if that one became BMBE-registered within the same year which made him/her exempted to paying income tax? Will he/she needs to file/pay percentage tax again? Will he/she be penalized for not filing/paying percentage in the months he/she was not yet BMBE registered?

    1. Hi Claire, no it’s not covered. If you opted for 8%, you only file for income tax. That means that you won’t have to file Percentage Tax for the 8% income tax rate.

  8. hello sir i would like to ask my employer impose with holding tax, in our monthly salary or PF and they ask as to acquire Sworn affidavit for having 8 percent deduction during the registration we tick the portion in form 1901 that we are availing 8 percent tax, then BIR issued to us our COR but in COR still shows that in 4th quarter filling we will file the 2551Q which is percentage tax, is it normal? or we can fill up the 22551Q and we will select the 8 percent instead of percentage tax? if we do this, procedure is this will lead to an open case or is it just normal procedure. thanks for replying this..

  9. Sir, I have a small optical clinic. I am faithfully paying my percentage tax every quarter. I was not aware that the percentage tax was reduced from 3% to 1% until this week. Can I still amend my percentage tax return from the 3rd quarter of 2020 to 4th quarter of 2022? The excess payment for the whole period is about P23K which is aa big amount for a small clinic such as ours. Thank you for any reply.

      Good day!

      If you are filing via Taxumo, the calculation of percentage taxes is already set to 1% so you don’t have to worry about re-calculating your tax dues again.

  11. Hello! I just registered my business June 27, 2023. Opted in to 8%. So I am currently required to file the ff:
    -1701/1701A – ANNUAL INCOME TAX RETURN FOR INDIVIDUALS EARNING INCOME PURELY
    1701Q – QUARTERLY INCOME TAX RETURN

    -PERCENTAGE TAX – QUARTERLY
    2551Q – QUARTERLY PERCENTAGE TAX RETURN

    -REGISTRATION FEE
    0605 – PAYMENT FORM

    Taxumo is showing I have a tax due for CY 2022 which is already late for filing and has a 1000 compromise amount. Do I NEED to file that? I don’t understand since the next filing for me should be due on August, or I’m mistaken? Thank you

      There’s no need to file the 2022 Annual Income Tax Return since this is not yet applicable for you. You may simply HIDE the card to avoid confusion on your Current Filings tab. 🙂

  13. Hi! I just registered last May 15, 2023 my business. Accdg to my COR the taxes Ineed to file for are: annual income tax, individual imcome tax and percentage tax but my gross annual income is less than Php250.000. Read somewhere that under TRAIN law this is an exemption for paying said taxes. Do I still need to file for these taxes or not? I am getting confused here. Will greatly appreciate your help on this matter. Tnx!

      Congratulations on registering your business!🍻 While there are exemptions under the Tax Reform for Acceleration and Inclusion (TRAIN) law, you may still need to file tax returns for your business. Even if your gross annual income is below Php250,000, you might need to file an individual income tax return if you have other sources of income exceeding the threshold. Similarly, businesses with gross sales under Php3,000,000 are exempt from percentage tax, but it’s wise to confirm with your local tax authority.

  14. Hi! I’m just new with this 2551Q filing thing. If I did not have any income for a whole quarter, do I still have to file this? Cause I did that for form 1701Q where I just put zero. And also, do you recommend using eBIR forms for filing 2551Q?

  16. I have been opting for the 8% income tax rate, and upon reviewing my Certificate of Registration (COR), it indicates that I need to file forms 0605, 2551Q, 1701Q, and 1701. However, I haven’t been filing 2551Q for several years since I started with the 8% income tax rate. May penalty po ba? Or do I need to file the 2551q talaga?

      Even if naka 8% po tayo, we are still required to file the form 2551Q under ZERO dues unless pinatanggal na natin yung form 2551Q sa COR natin. 🙂

  17. I have been opting for the 8% income tax rate, and upon reviewing my Certificate of Registration (COR), it indicates that I need to file forms 0605, 2551Q, 1701Q, and 1701. However, I haven’t been filing 2551Q for several years since I started with the 8% income tax rate.

    I recently discovered that although my Certificate of Registration (COR) indicates percentage tax, my Statement of Income Payments, Exemptions, and Deductions (SD) reflects an 8% tax rate. This has left me confused about my tax classification. Additionally, my COR specifies the filing of BIR Form 1701, but there’s no mention of 1701A.

    I’m seeking clarification on whether the 8% tax rate in my SD overrides the percentage tax indication in my COR. Also, I’d like guidance on the difference between filing BIR Form 1701 and 1701A, as my COR only mentions the former.

      If the form 2551Q is indicated in our COR, we are still required to file it under ZERO dues unless we updated our COR and have this form removed.

      For the form 1701A this is being submitted by individuals/business owners under 8% rate or Graduated Income Tax with OSD deduction method. The form 1701 is for individuals or business owners who are using the Itemized Deduction method or mixed income earners. 🙂
